The governments of the United Kingdom and Switzerland have just signed a new bilateral social security agreement. It is expected to enter into force at the end of 2021. When brexit formalities took place on 1 January 2021, the UK was immediately subject to new customs and trade standards, both from the EU and from third countries that had trade agreements with the EU that previously applied to the UK. The UK and Switzerland had been negotiating for some time on how trade between the two countries would work after Brexit, so on January 1, 2021, when Brexit followed, the UK-Switzerland Free Trade Agreement immediately came into force. In order to ensure that the existing reciprocal rights and obligations in Switzerland`s relations with the United Kingdom continue to apply as far as possible beyond this transitional period and to provide a basis for the development of relations in the future, Switzerland has concluded agreements with the United Kingdom in certain areas, including trade. The trade agreement will enter into force as soon as the bilateral agreements between Switzerland and the EU cease to be effective for relations between Switzerland and the United Kingdom. In order to regulate social security relations comprehensively and systematically, the two countries have negotiated a new bilateral agreement, which was recently approved by the Swiss and British governments. This agreement is important to ensure the most effective coordination of social security legislation in both countries. The Committee notes that the trade agreement differs considerably from the previous agreement to which the United Kingdom acceded as an EU Member State. These differences include: Britain has signed a transport agreement with Switzerland. The agreement ensures that UK freight forwarders can continue to operate in Switzerland with a Community licence once the agreement enters into force.

The agreement will enter into full force once it has been adopted by the Parliaments of Switzerland and the United Kingdom. The new social security agreement between Switzerland and the United Kingdom is not yet in force, as the parliaments of both countries are still awaiting approval7. The agreement should not be retroactive. Great Britain is an important economic partner of Switzerland. Relations between Switzerland and the United Kingdom are currently governed mainly by bilateral agreements with the European Union (EU). According to the Withdrawal Agreement between the UK and the EU, there is a transition period that lasts from the withdrawal date until at least 31 December 2020. During this transition period, the UK will remain a member of the European single market and the customs union. Relations between Switzerland and the United Kingdom will continue to be governed by the terms of the bilateral agreements between Switzerland and the EU.

During the transition period, the UK will remain a member of the European Customs Union until the end of December 2020.

After the end of the transitional period, it will no longer be possible to transform the goods as an intra-Community supply. You will then need to export from the EU and then import to the UK. Particularly important: for exports from the EU, the exporter must reside in the EU under customs legislation. According to the CH-UK trade agreement, goods of Swiss origin that are definitively imported and stored in the EU will lose their preferential origin from 1 January 2021. However, if unprocessed goods are returned to Switzerland and then re-exported from there to the UK, they will continue to have preferential status. However, goods stored in a customs warehouse retain their declared origin and can be shipped directly to the UK. The new social security agreement between Switzerland and the United Kingdom has been signed and published1 and it is planned to apply it provisionally from 1 November 2021, subject to the approval of the competent UK authorities. The agreement itself largely corresponds to the coordination of social security systems under the new EU-UK Trade and Cooperation Agreement2 and is based on the principles of EU coordination law that Switzerland applies under the AFMP. Analysis and comments: The agreement, if ratified by both countries, will provide some security for employers and British and Swiss nationals residing in each other`s countries.

Although some procedures are not yet clear after Brexit and after the transition, it is likely that workers will be able to continue working and living in their respective host countries depending on their current status. Employers must ensure that nationals who need a work and residence permit in a post-Brexit scenario are properly prepared. The 11-month Brexit transition period agreed between London and Brussels expires on 31 December, when the UK will also leave the single market and the EU customs union and international agreements relating to the UK will no longer apply. Switzerland and the United Kingdom are also entering a new phase in their relations. Although the Swiss-EU agreements will continue to apply to the UK throughout the transition period, they will no longer apply from 2021. From 2021, the monitoring rules will apply, including several new agreements between Switzerland and the United Kingdom. These new Swiss solutions stem from the Mind the Gap strategy adopted by the Federal Council in October 2016, a few months after the Brexit vote on 23 June of the same year. The aim of the Mind the Gap strategy was to safeguard the rights and obligations applicable between Switzerland and the United Kingdom and, if possible, to extend them. To coordinate the strategy, the Federal Council has set up an inter-service steering group led by the FDFA. Switzerland and great Britain have largely been able to maintain their existing legal relations. In total, the Federal Council has negotiated seven agreements with the UK government.• The scheduled flight agreement signed on 17 December 2018 ensures that existing aviation rules continue to apply fully and that air carriers can retain their previous traffic rights.

The agreement enters into force on 1 August. January 2021 in force.• The Convention on the International Carriage of Passengers and Goods by Road (signed on 25 January 2019) allows carriers to continue to carry goods without authorisation and ensures the continued carriage of passengers and goods between the two countries. The agreement enters into force on 1 January 2021.• The agreement on direct insurance other than life insurance (signed on 25 January 2019) allows Swiss insurance companies operating in the field of direct insurance to operate and establish branches in the United Kingdom (and vice versa for British insurance companies). The agreement will enter into force on 1 January 2021.• The trade agreement (signed on 11 January 2021). February 2019) transfers several relevant agreements with the EU to relations between Switzerland and the United Kingdom, including the Free Trade Agreement (1972), the Agreement on Government Procurement (1999), the Mutual Recognition Agreement (1999), the Agreement on Agriculture (1999) and the Anti-Fraud Agreement (2004). The trade agreement will enter into force on 1 January 2021.
